Terms of Service

Welcome to Gunjon. These Terms of Service ("Terms") govern your access to and use of our platform. By using Gunjon, you agree to these Terms.

1. Acceptance of Terms

By accessing or using Gunjon, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use our services.

These Terms constitute a legally binding agreement between you and Gunjon Inc. ("Gunjon," "we," "us," or "our").

2. Eligibility

To use Gunjon, you must:

  • Be at least 18 years old
  • Have the legal capacity to enter into binding contracts
  • Not be prohibited from using our services under applicable law
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials

3. User Accounts

Account Types

Gunjon offers two account types:

  • Creator Accounts: For content creators seeking brand partnerships
  • Brand Accounts: For businesses seeking creator collaborations

Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Ensuring your profile information remains accurate and current

Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or harm other users or our platform.

4. Acceptable Use

You agree NOT to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights of others
  • Post false, misleading, or fraudulent information
  • Harass, abuse, or harm other users
  • Spam or send unsolicited communications
  • Attempt to gain unauthorized access to our systems
  • Use automated tools to scrape or collect data
  • Interfere with platform functionality or security
  • Impersonate others or misrepresent your identity
  • Use the platform for any illegal purpose

5. Creator-Specific Terms

Profile and Portfolio

  • You grant Gunjon permission to display your profile to brands
  • You represent that your portfolio content is your original work or properly licensed
  • You may connect social media accounts to import metrics and insights

Campaign Participation

  • Campaign agreements are between you and the brand
  • You must deliver content according to agreed specifications and deadlines
  • You retain ownership of content you create, subject to usage rights granted to brands
  • Payment terms are defined in individual campaign agreements

Social Media Access

  • Connecting social accounts is optional but enhances your profile
  • You authorize us to access permitted data through official APIs
  • You may revoke access at any time through your account settings
  • We will not post content to your accounts without explicit permission

6. Brand-Specific Terms

Campaign Creation

  • You must provide clear, complete campaign briefs and requirements
  • You are responsible for timely review and feedback on submissions
  • You agree to compensate creators according to agreed terms

Content Rights

  • Usage rights to creator content are defined in campaign agreements
  • You must respect creator intellectual property rights
  • You may not use content beyond agreed scope without permission

Creator Relationships

  • Treat creators with professionalism and respect
  • Provide constructive, timely feedback
  • Honor payment commitments

7. Payments and Fees

Platform Fees

Gunjon may charge service fees for platform use. Current pricing is available on our Pricing page. We reserve the right to modify fees with reasonable notice.

Payment Processing

  • Payments are processed through third-party payment providers
  • You agree to their terms and fees
  • We are not responsible for payment processor errors or delays

Refunds

Refund policies are campaign-specific and defined in individual agreements. Platform fees are generally non-refundable.

8. Intellectual Property

Platform Rights

Gunjon and its content (excluding user-generated content) are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our platform or branding without permission.

User Content

You retain ownership of content you upload. By posting content, you grant Gunjon a limited license to display, store, and distribute it as necessary to provide our services.

DMCA Policy

We respect intellectual property rights. If you believe content on our platform infringes your copyright, contact us.

9. Disclaimers and Warranties

OUR PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, express or implied, including:

  • Warranties of merchantability or fitness for a particular purpose
  • Guarantees of uninterrupted or error-free service
  • Promises regarding campaign outcomes or creator/brand quality
  • Responsibility for user conduct or content accuracy

Gunjon facilitates connections but does not guarantee results. You use the platform at your own risk.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GUNJON SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages
  • Lost profits, revenue, data, or business opportunities
  • Damages arising from user conduct or content
  • Campaign disputes between creators and brands
  • Third-party service failures (payment processors, social media APIs)

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless Gunjon, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

  • Your use of the platform
  • Your violation of these Terms
  • Your infringement of any third-party rights
  • Your conduct toward other users

12. Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

Arbitration

Any disputes arising from these Terms or use of Gunjon shall be resolved through binding arbitration, except where prohibited by law. You waive the right to participate in class actions.

Informal Resolution

Before filing arbitration, you agree to contact us to attempt informal resolution.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or platform notification. Continued use after changes constitutes acceptance of the updated Terms.

14. Termination

You may terminate your account at any time through your account settings. We may terminate or suspend your account immediately if you violate these Terms.

Upon termination:

  • Your right to use the platform ends immediately
  • Your profile and data will be deleted per our Privacy Policy
  • Outstanding payment obligations remain in effect
  • Provisions intended to survive termination (liability, indemnification) continue

15. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Gunjon.

Severability: If any provision is found unenforceable, the remaining provisions remain in effect.

No Waiver: Our failure to enforce any right does not waive that right.

Assignment: You may not assign these Terms without our consent. We may assign them without restriction.

Force Majeure: We are not liable for delays or failures due to circumstances beyond our reasonable control.
